Terms of Service

Effective: 1 May 2026

1. Agreement

These Terms govern your use of Cox's Bazar Surf Hub ("the Hub", "we"), operated by Cox's Bazar Surf Hub Private Limited, a private limited company registered in Bangladesh under the Companies Act 1994 (RJSC C-208654/2026), with its registered office at Marine Drive Road, South Kalatoli, Cox's Bazar 4700, Bangladesh, operating under a valid Bangladesh trade licence. By booking a session, entering our premises, or using this website, you agree to these Terms.

These Terms are governed by, and these activities operate under, the following Bangladesh instruments: the Companies Act 1994; the Contract Act 1872; the Bangladesh Labour Act 2006; the Consumer Rights Protection Act 2009; tort law principles of Bangladesh; the Tourism Act and Bangladesh Tourism Board regulations; the Ports Act 1908 and Bangladesh Coast Guard Act 2016 (where applicable); and the Food Safety Act 2013 (for café and beach-food operations).

For water-based activities, you must additionally sign our Liability Waiver before entering the water. Any safety-related instructions issued under our Ocean Safety SOP override anything stated here.

2. Booking and payment

  • Bookings are confirmed only when payment is received or, for Cash-on-Arrival, when you arrive on time for your session.
  • Accepted payment methods: bKash, Nagad, bank transfer, or cash. All prices in BDT unless stated.
  • Sessions run rain or shine unless the sea is flagged unsafe by our Head of Ocean Safety. See section 5.
  • A valid phone number and emergency contact are required for every booking.

3. Cancellation and refund policy

Refunds are processed through the original payment method within 7 business days. Bank or bKash/Nagad fees may apply.

Memberships: cancellable with 30 days' notice. No partial-month refunds. Unused sessions do not roll over past the membership period.

4. Our right to cancel

We may cancel or reschedule a session if:

  • The sea is unsafe (Red or Double Red flag, cyclone warning, flash rip conditions, jellyfish swarm). Full refund or free reschedule.
  • You arrive visibly intoxicated or unable to follow safety instructions. No refund.
  • You decline or fail to complete the mandatory Cox's Bazar Ocean Safety briefing. We will reschedule you to complete it; no refund for the missed slot.
  • You withhold a medical condition that materially affects your safety (see Liability Waiver).
  • You behave in a way that endangers yourself, our staff, other customers, or the operating environment.

5. Weather and water-condition policy

The Hub operates a five-flag condition system (Green, Yellow, Red, Double Red, Purple) under our Ocean Safety SOP, benchmarked to the public guidelines of the International Life Saving Federation (ILS) and adapted for the Bay of Bengal. The Head of Ocean Safety has absolute and un-overrideable authority to close the water and to evacuate the beach zone. Decisions are final. If we cancel because the water is closed, you get a full refund or free reschedule.

6. Your conduct

You agree to:

  • Follow all safety instructions from coaches and staff at all times.
  • Disclose any medical condition relevant to water activity.
  • Treat staff, coaches, and other guests respectfully. Harassment results in immediate removal without refund.
  • Respect the beach and marine environment.
  • Use our equipment with reasonable care. You are responsible for damage caused by negligence.

7. Photography and media

We photograph and video our sessions for instructional feedback and promotional use. By attending, you consent to being captured in wide group shots. If you do not wish to appear in close-up marketing content, tell us at the start of your session and we will honour the request.

8. Personal belongings

Lockers are provided but we do not insure the contents. We are not liable for loss or damage to personal property except where caused by our wilful misconduct.

9. Limitation of liability

Surf, swim, and open-water activities carry inherent risk (see the Liability Waiver). To the fullest extent permitted by Bangladesh law, our liability to you is limited to the amount you paid for the specific session or membership giving rise to the claim, except for claims arising from our gross negligence, wilful misconduct, or fraud.

We are not liable for indirect or consequential loss (lost travel costs, hotel bookings, missed flights, etc.).

10. Website and Arif Connect AI

This website is provided "as is". The Arif Connect AI feature generates text using a third-party language model. It is not a substitute for professional coaching or medical advice. Do not rely on AI output for safety-critical decisions.

11. Changes to these Terms

We may update these Terms. The current version will always be posted here. Material changes apply to bookings made after the posted "Effective" date.

12. Governing law and jurisdiction

These Terms are governed by the laws of Bangladesh. Any dispute will be resolved in the courts of Cox's Bazar, Bangladesh, after a good-faith attempt at direct negotiation.
