Cox's Bazar Surf Hub Private Limited ("the Company", "we", "our") is a registered private limited company incorporated under the Companies Act 1994 of Bangladesh. These Master Terms & Conditions ("Terms") govern all interactions between the Company and any customer, visitor, user, or participant ("you", "the Customer"). By booking any service, entering our premises, or using our digital platforms, you agree to be bound by these Terms.
These Terms are governed by and construed in accordance with the laws of the People's Republic of Bangladesh, including but not limited to:
Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Cox's Bazar District and, where applicable, the High Court Division of the Supreme Court of Bangladesh.
You accept these Terms by:
5.1 All surf lesson bookings are subject to availability and weather/sea conditions.
5.2 A signed Liability Waiver is mandatory before any water activity commences.
5.3 Instructors have absolute authority over safety decisions in and out of the water.
5.4 The Company reserves the right to cancel or modify lessons due to unsafe conditions without penalty.
5.5 Participants must disclose medical conditions, disabilities, or physical limitations prior to sessions.
5.6 Alcohol and drug use before or during sessions is strictly prohibited and will result in removal.
6.1 Surf safaris require advance booking and a minimum group size as communicated at time of booking.
6.2 All participants must sign the Liability Waiver and the Surf Safari Booking Contract.
6.3 Transport, accommodation (where included), and meals are subject to the conditions set out in the Safari Booking Agreement.
6.4 The Company is not liable for third-party service failures (hotels, transport providers, etc.) unless directly caused by Company negligence.
7.1 All retail sales are final unless items are defective upon purchase.
7.2 Defective items may be exchanged within 7 days of purchase with proof of purchase.
7.3 The Company does not offer refunds on surfboards or large equipment once assembled or used.
7.4 Online orders are subject to our E-Commerce & Shipping Policy available on our website.
8.1 The Company complies with the Food Safety Act 2013 and all relevant hygiene regulations.
8.2 Customers with food allergies or dietary restrictions must inform staff before ordering.
8.3 The Company is not liable for allergic reactions where allergen information was not disclosed.
8.4 The Company reserves the right to refuse service to intoxicated, disruptive, or abusive individuals.
8.5 Restaurant seating is subject to availability. Reservations may be required during peak seasons.
9.1 All gym members and day-pass users must sign a Membership Agreement.
9.2 Medical clearance may be required for individuals with health conditions.
9.3 Users must follow posted gym rules and staff instructions at all times.
9.4 The Company is not liable for personal injury arising from improper equipment use.
9.5 Personal belongings are the responsibility of the user. The Company is not liable for loss or theft.
10.1 Coaching programmes require a signed Coaching Agreement detailing scope, schedule, and fees.
10.2 Coaches may not be substituted without prior notice. In case of coach unavailability, an alternative will be arranged or a reschedule offered.
10.3 Results from personal coaching are not guaranteed. Progress depends on individual effort and commitment.
11.1 Use of the Company's website, app, and social media channels is subject to the Privacy Policy and Cookie Policy.
11.2 Users must not post defamatory, false, or harmful content about the Company or its staff on any platform.
11.3 The Company reserves the right to remove user-generated content that violates our Community Guidelines.
11.4 Online purchases are governed by the Consumer Rights Protection Act 2009.
All content owned by Cox's Bazar Surf Hub — including but not limited to logos, brand name, website content, photographs, videos, curricula, and social media content — is protected under the Copyright Act 2000 of Bangladesh and applicable international conventions. Unauthorised reproduction, distribution, or commercial use is strictly prohibited and may result in legal action.
To the maximum extent permitted under Bangladeshi law, the Company's total liability to any Customer in connection with any claim shall not exceed the amount paid by that Customer for the specific service giving rise to the claim. The Company shall not be liable for indirect, incidental, consequential, or special damages.
The Company shall not be liable for failure to perform obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, government restrictions, civil unrest, pandemic, extreme weather events, or power failures. In such cases, affected bookings will be offered reschedules or credit.
These Terms may be updated at any time. The latest version is available at our premises and on our official website. Continued use of our services constitutes acceptance of any amendments.
If any provision of these Terms is found unlawful or unenforceable by a competent court, the remaining provisions shall continue in full force and effect.
These Terms, together with any service-specific agreements, waivers, or policies referenced herein, constitute the entire agreement between the Company and the Customer and supersede all prior representations or understandings.
